Rafael Rodriguez, a 50-year-old, alleged an industrial injury to his lower back while working as a Clinical Partner for a hospital in Los Angeles, CA.

Surveillance depicted Rodriguez jogging uphill and downhill on 3-mile course for 80 minutes. Rodriguez underwent a medical exam shortly thereafter and stated that he is unable to sit, stretch, stand, or walk for more than 15 minutes, resulting in his being deemed total temporary disabled. 

The material misrepresentations made to the Doctor prompted referral to VRC Investigations’ Special Investigation Unit for suspected fraud.

SIU met with the PTP who thereafter issued a report and opined that Rodriguez could have returned to work full duty on first date of film, providing cost benefit to the claim by stopping unwarranted TTD.
